Terms of Service

These terms govern your use of FocusStat (the "Service"), a web analytics platform. By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

1. The Service

FocusStat provides website analytics: traffic measurement, behavioral analytics (including optional session replay and heatmaps), real-user performance monitoring, error monitoring, and AI-assisted analysis of your own analytics data. You add a tracking script to websites you control; the Service collects and presents usage data for those websites as described in our Privacy Policy.

2. Accounts

  • You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
  • You must be legally able to enter into this agreement.
  • We may suspend or terminate accounts that violate these terms.

3. Your responsibilities as a website owner

You may only install the tracking script on websites you own or are authorized to instrument. You are the data controller for your sites' analytics data, which means you are responsible for:

  • complying with the laws that apply to you and your visitors (e.g. GDPR, ePrivacy, CCPA), including any required disclosures or consent on your own website;
  • informing your visitors about analytics in your own privacy notice;
  • configuring the Service appropriately for your obligations (e.g. cookieless mode, masking, retention, replay sampling);
  • not using the Service to collect data you are not permitted to collect.

4. Acceptable use

You agree not to:

  • track websites without authorization, or attempt to deanonymize visitors;
  • use the Service for unlawful, deceptive, or harmful purposes;
  • probe, overload, disrupt, or circumvent the Service's security or rate limits;
  • resell or white-label the Service without our written agreement.

5. Your data

  • You own the analytics data collected from your websites. We process it only to provide the Service.
  • You can export your data (CSV) and delete it at any time: per visitor, per site, or entirely.
  • We may compute aggregate, non-identifying service statistics (e.g. total events processed) to operate and improve the Service.

6. AI features

AI-generated explanations are produced from aggregated statistics and are clearly separated into facts (computed by the Service) and hypotheses (possible explanations). Hypotheses are informed guesses, not guarantees. Verify before making significant business decisions. AI features may be rate-limited and may use third-party model providers as described in the Privacy Policy.

7. Availability and support

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We work to keep it reliable but do not guarantee uninterrupted operation, and analytics collection gaps can occur (e.g. ad blockers, network failures, maintenance). The tracking script is designed to never break your website, but we cannot guarantee behavior in every environment.

8. Fees

Current pricing (including any free tier) is presented at signup or in the dashboard. If paid plans are introduced or changed, we will give existing account holders reasonable notice before changes affect them.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the twelve months before the claim (or $50 if you paid nothing).

10. Termination

You may stop using the Service and delete your data at any time. We may suspend or terminate access for violations of these terms, with notice where practicable. Upon termination we will delete your data within a reasonable period, except where retention is legally required.

11. Changes and contact

We may update these terms; material changes will be announced in the dashboard, and the date above will be updated. Continued use after changes means acceptance. Questions: admin@focusstat.com.
